Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Gated website (getgated.ai), APIs, console, documentation, and related services (the "Services") provided by M6L LLC ("M6L," "we," "us," or "our"). By creating an account, provisioning an API key, or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms (and the Master Services Agreement, which is incorporated by reference for commercial customers).

1. Description of Services

Gated provides pre-inference request screening, rate limiting, and usage telemetry designed to help software developers and e-commerce merchants identify and block abusive, off-topic, or policy-violating messages before forwarding requests to downstream artificial intelligence providers.

2. Account Registration & 24-Hour Email Verification

• Accurate Registration: You must provide a valid, reachable email address (or authenticate through a supported identity provider) to provision a Gated API key. Automated, disposable, or nonexistent email domains are rejected.
• 24-Hour Verification Window: To prevent automated abuse, newly provisioned Starter trial accounts must confirm their email address within 24 hours of creation. If an account remains unverified after 24 hours, the associated API key is automatically locked until verification is completed.
• API Key Security: You are responsible for keeping your M6L_GATE_KEY and account credentials confidential and for all activity conducted under your account. You must store your API key in server-side environment variables and never expose it in public client-side code.

3. Starter Trial, Quota Fail-Open Behavior & Paid Plans

• Starter Trial (250 Free Checks): Each eligible customer account receives a one-time Starter allowance of 250 screening checks at no charge (limited to one free trial per operator and device/network).
• Fail-Open Behavior Upon Quota Exhaustion: Gated is designed to avoid interrupting your live application. When a Starter or paid account reaches 100% of its monthly check quota, the screening API continues returning HTTP 200 responses with allow: true and quota_exceeded: true, and active threat blocking pauses until you upgrade your plan or your next monthly billing cycle begins. You acknowledge and agree that unscreened passthrough traffic processed after quota exhaustion is not inspected for threats.
• Paid Subscriptions ($19/mo Builder & $49/mo Business): Paid plans are billed monthly in advance via Stripe (Builder at $19/month for 25,000 included checks/month; Business at $49/month for 250,000 included checks/month plus programmatic Analytics Export & Abusive-User Correlation API access, unless otherwise stated on your order). Both paid plans support optional, customer-controlled Auto-Scale overage packs at a unified flat rate of $10 per 50,000 additional checks ($0.00020 per check), governed by the monthly pack cap configured in your console. Subscriptions renew automatically each month unless canceled prior to the renewal date through your console or by contacting support.

4. Acceptable Use & Restrictions

You agree not to, and not to permit any third party to:

• Use the Services to violate any applicable law, regulation, or third-party right.
• Attempt to reverse-engineer, decompile, scrape, or systematically probe Gated endpoints for the purpose of extracting our proprietary classification rules, scoring thresholds, or detection logic, or to build a competing product.
• Bypass trial limits, device locks, or rate limits by creating multiple accounts or rotating identifiers.
• Interfere with or disrupt the integrity, performance, or availability of the Services through denial-of-service attacks or automated load testing without prior written consent from M6L LLC.

5. Nature of Automated Risk Screening & Customer Responsibility

Gated is a risk-reduction and cost-control tool. Automated text screening cannot guarantee that 100% of adversarial prompts, jailbreaks, or fraudulent requests will be detected, nor that every legitimate user message will be allowed without false positives. You remain solely responsible for:

• Configuring your downstream application logic, payment flows, discount code generation, and database permissions (for example, never granting an AI assistant direct unauthenticated permission to issue refunds or expose sensitive records).
• Reviewing your application's behavior when Gated returns an allow, flag, or block decision.

6. Intellectual Property & Customer Data

As between the parties, you retain all right, title, and interest in your applications and the requests submitted by your users. M6L LLC retains all right, title, and interest in the Gated platform, APIs, documentation, detection rules, and aggregate service telemetry.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. M6L LLC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR IMPERVIOUS TO ALL ADVERSARIAL PROMPTS OR SECURITY EXPLOITS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL M6L LLC OR ITS OFFICERS, MEMBERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, AI PROVIDER CREDITS, PROMOTIONAL DISCOUNTS, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. M6L LLC'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO M6L LLC IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

9. Termination

You may stop using the Services and cancel your subscription at any time. M6L LLC may suspend or terminate your access to the Services immediately if you breach Section 4 (Acceptable Use), fail to pay applicable fees, or create a security risk to the Services.

10. Governing Law & Contact

These Terms are governed by the laws of the United States and the state in which M6L LLC is organized, without regard to conflict-of-law principles. Questions about these Terms may be sent to legal@m6l.ai or submitted via the Customer Console Service Desk.
